A blatant steal of a topic from elsewhere on the web, but what can you do? wink.gif

"In October 2004 Padraig Nally, a 60-year-old Mayo farmer, shot and killed John Ward, whom he had caught apparently trying to break into his house. I won't go into the details because it's fairly long and complicated (it's currently being retrialed) and there's plenty on Google.

At the moment, Irish law obliges a homeowner to retreat if possible when faced with an attacker or burgler, and to submit otherwise. Defense is not allowed; that's for the police to handle, and if you attack the burgler, you could actually be sued by him later. In light of the Padraig Nally case, there's talk in legislative circles of changing the law to allow homeowners to defend their property. Most people are for it, but how far is enough? Repel, subdue or even kill when those don't work? Obviously using more force than is necessary to deal with a situation is not a good idea, but at what point should a homeowner be obliged to switch from defense back to retreat?

I know the law is different in other countries, I'm just looking for opinions on what should be the correct way."
